In order to qualify for social security disability benefits, such as SSDI or SSI, a person be unable to engage in substantial gainful activity as a result of a medical condition – physical or mental – that has lasted or is expected to last for at least 12 months or is expected to result in death.

In order to help with the evaluation of mental health impairments, the Social Security Administration (SSA) established Section 12.00 of the SSA’s “Listing of Impairments.” The SSA arranges the various mental health disabilities into nine diagnostic categories:

  • Organic mental disorders
  • Schizophrenic, paranoid and other psychotic disorders
  • Affective disorders
  • Mental retardation
  • Anxiety-related disorders
  • Somatoform disorders
  • Personality disorders
  • Substance addiction disorders
  • Autistic disorder and other pervasive developmental disorders

For each category, with the exception of mental retardation and substance addiction disorders, the SSA provides a statement describing the disorder(s) addressed by the listing, applicable medical findings, and impairment-related functional limitations to assist in evaluation of the social security disability claim.

If you do not meet the SSA’s listing requirements under Section 12.00, you may still qualify for social security disability laws if you can show that your residual functional capacity is limited to the extent that you are unable to perform any kind of work.

If you suffer from a mental health condition and are unable to work as a result, contact the experienced Chicago social security disability attorneys at Ankin Law at (872) 529-9377 to discuss a possible disability claim.
